Terms and Conditions: Swim Clinics, Pre-Written Programs, Remote Programming
1. Acceptance of Terms
By registering for any ASP swim clinic, purchasing a pre-written program, subscribing to remote programming for athletes or individuals, or engaging in any other ASP service, you (or your legal guardian if under 18) accept these terms in full.

3. Participation Rules
Follow all facility and staff instructions, respect equipment and participants, and maintain proper hygiene.
Inappropriate conduct may result in immediate removal without refund or credit.

5. Service Modification
ASP may modify, suspend, or cancel services, schedules, or fees at any time. Notice will be provided for material changes.
6. Personal Data Privacy
Personal data is collected solely to deliver services, communicate updates, and meet legal obligations. ASP does not share data with third parties without consent unless required by law.
7. Photography and Media Release
You grant ASP the right to use photos or videos taken during services for promotional purposes without further compensation.
8. Waiver of Liability
a. I understand the nature of Strength and Conditioning or Personal Training activities and believe I am qualified to participate in such Activity. I further acknowledge that I am aware the activity will be conducted in a gym setting during the Activity. I further agree and warrant that if at any time I believe conditions to be unsafe, I will immediately discontinue further participation in the Activity.
b. All athletes (in-person, remote, club team remote, Youth Sports Performance athletes) and their guardians fully understand that:
i. Strength and Conditioning and Personal Training Activities involve risks and dangers of serious bodily injury, including permanent disability, paralysis, and death (“Risks”).
ii. These Risks and dangers may be caused by my own actions or inaction, the actions or inactions of others participating in the Activity, the condition in which the Activity takes place, or the negligence of the “Releasees” named below.
iii. There may be other risks and social and economic losses either not known to me or not readily foreseeable at this time, and I fully accept and assume all such Risks and all responsibility for losses, costs, and damages incurred as a result of my participation in the Activity.
c. I hereby release, discharge, covenant not to sue, and agree to indemnify and save and hold harmless Aquatic Sports Performance, any respective administrators, directors, agents, officers, volunteers, and employees, other participants, any sponsors, advertisers, and if applicable, owners and lessors of premises on which the Activity takes place (each considered one of the “Releasees” herein) from all liability, claims, demands, losses, or damages on my account caused or alleged to be caused in whole or in part by the negligence of the Releasees or otherwise, including negligent rescue operations, and further agree that if, despite this release, I or anyone on my behalf makes a claim against any of the Releasees named above, I will indemnify, save, and hold harmless each of the Releasees from any litigation expenses, attorney fees, loss liability, damage, or costs any may incur as the result of any such claim.
9. Right to Refuse Service
ASP may refuse or terminate service to anyone who violates these terms or whose behavior endangers others.
10. Communication and Updates
ASP may send you service-related emails or messages. You may opt out of marketing communications at any time. Continued use of services after updates constitutes acceptance of the revised terms.
11. Entire Agreement
These terms constitute the complete agreement for ASP swim clinics, pre-written programs, remote programming, and any other ASP activities, superseding any prior verbal or written statements.
