This Privacy Notice for Aquatic Sports Performance LLC (doing business as ASP) ("we," "us," or "our") describes how and why we might access, collect, store, use, and/or share ("process") your personal information when you use our services ("Services"), including when you:

- Download and use our mobile application ASP Nexus, or any other application of ours that links to this Privacy Notice;
- Book, attend, or participate in our coaching, swim, strength, performance-testing, or clinic programs; or
- Engage with us in other related ways, including any sales, marketing, or events.

What personal information do we process? When you visit, use, or navigate our Services, we process personal information depending on how you interact with us, the choices you make, and the products and features you use — including the account, contact, training, and payment information described below.
Do we process any sensitive personal information? Yes. Because ASP is a coaching and performance-training service, we process health and fitness information — such as workout logs, performance-test results, body measurements, and readiness/wellness check-ins — which is treated as sensitive in some jurisdictions. We process this information to deliver our training services and, where required by law, only with your explicit consent. We do not request information about racial or ethnic origin, political opinions, religious beliefs, sexual orientation, or genetic or biometric identifiers.
Do we collect information from minors? Yes. Many of our athletes are children and teenagers, and we knowingly collect their information with the consent and involvement of a parent or guardian. Learn more in the Children's Privacy section below.
Do we collect any information from third parties? We collect personal information primarily from you directly and automatically from your devices. We do not buy personal information from data brokers. Our payment and analytics partners may provide us with limited information (for example, the status of a payment, or aggregated analytics and advertising measurement).
How do we process your information? We process your information to provide, improve, and administer our Services, to communicate with you, for security and fraud prevention, and to comply with law. We process your information only when we have a valid legal reason to do so.
In what situations and with which parties do we share personal information? We share information with the service providers that help us run the Services (such as our hosting, payment, email, SMS, performance-testing, accounting, and error-monitoring partners) and in other specific situations described below. We do not sell your personal information for money.
How do we keep your information safe? We have organizational and technical processes in place to protect your personal information. However, no electronic transmission or storage technology can be guaranteed to be 100% secure.
What are your rights? Depending on where you are located, applicable privacy law may give you rights regarding your personal information, including the right to access, correct, or delete it.
How do you exercise your rights? You can delete your account directly in the ASP Nexus app, or contact us at team@aquaticsportsperformance.com. We will consider and act upon any request in accordance with applicable data protection laws.

1. What Information Do We Collect?
Personal information you disclose to us
We collect personal information that you voluntarily provide when you register for the Services, create or manage an athlete account, book a session or program, express interest in our products and Services, participate in activities in the Services, or otherwise contact us. The personal information we collect may include the following:
- Names (including the names of athletes and of a parent/guardian)
- Email addresses
- Phone numbers
- Mailing and billing addresses
- Passwords (stored in hashed form by our authentication provider)
- Date of birth (used to determine age-appropriate features and consent requirements)
- Profile photo (optional)
- Emergency contact name, phone number, and relationship
- Contact and communication preferences
- Documents you sign electronically (such as waivers and terms acceptance)
Health and fitness information (sensitive information)
Because our Services are built around athletic coaching and performance training, we collect health- and fitness-related information. This may include:
- Workout and training logs (exercises, sets, repetitions, weights, durations, and your notes)
- Performance-test and assessment results (for example, body weight, jump height, strength and grip measurements, speed and agility times, power output, and swim race times)
- Readiness and wellness check-ins (such as sleep quality, energy, mood, stress, and muscle soreness ratings)
- Technique and movement videos you choose to upload for coach review
- Membership, attendance, check-in, and booking history
We process this health and fitness information to provide our coaching and training Services to you. Where required by applicable law, we rely on your explicit consent to process it, and you may withdraw that consent or ask us to delete the information at any time, as described in the privacy-rights section below. Communications and content you create
When you use in-app chat, community features, or upload documents, photos, or videos, we collect the content you submit, along with related metadata (such as timestamps and read status). Community posts and comments may be visible to other members of the relevant program, and may remain visible to them even after you delete your copy.
Payment data
We may collect data necessary to process your payment if you make a purchase, such as your payment-card information and billing address. All card data is collected and stored directly by our payment processor, Stripe — we do not store your full card number or security code on our systems. You may review Stripe's privacy notice at https://stripe.com/privacy.
Application data
If you use the ASP Nexus mobile application, we may collect the following with your permission:
- Camera and photo library. With your permission, we access your camera and photo library so you can set a profile photo and record or upload technique videos for coach review. You can change these permissions at any time in your device settings.
- Push notifications. With your permission, we send push notifications about your account, sessions, bookings, chat messages, and workout timers. You can opt out at any time in your device settings.
- Mobile device data. We collect certain device information such as device model and operating system, app version, language and time-zone settings, unique device identifiers, and (for diagnostics) crash and error reports.
The ASP Nexus app does not request access to your precise location, microphone, contacts, or calendar. This information is primarily used to operate and secure the application, for troubleshooting, and for internal analytics and reporting.
All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.
Information automatically collected
We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, approximate location inferred from your IP address (we do not collect precise GPS location from your device), and information about how and when you use our Services. This information is primarily needed to maintain the security and operation of our Services and for our internal analytics and reporting purposes. Like many businesses, we also collect information through cookies and similar technologies on our website.
- Log and usage data. Service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services, recorded in log files. This may include your IP address, device information, browser type and settings, the pages and features you use, and error reports.
- Device data. Information about the computer, phone, tablet, or other device you use to access the Services, such as device and application identification numbers, browser type, hardware model, and internet service provider and/or mobile carrier.
2. How Do We Process Your Information?
We process your personal information for a variety of reasons, including to:
- Create and manage your account and athlete profiles, including parent-managed accounts for minors.
- Deliver and personalize coaching, training programs, assessments, and bookings.
- Process payments, memberships, and refunds.
- Send administrative information, confirmations, reminders, and updates about your sessions and account.
- Enable in-app chat and community features and respond to your inquiries.
- Send marketing and promotional communications where permitted. You can opt out of marketing emails at any time using the unsubscribe link in those emails, and of marketing text messages by replying STOP.
- Monitor, troubleshoot, and improve the safety, security, and performance of our Services.
- Comply with legal obligations and enforce our terms.
3. What Legal Bases Do We Rely On To Process Your Information?
We only process your personal information when we believe it is necessary and we have a valid legal reason to do so under applicable law.
If you are located in the EU or UK, we rely on the following legal bases: consent (which you may withdraw at any time); performance of a contract to provide the Services you have requested; legitimate interests such as keeping our Services secure and improving them; and compliance with legal obligations. Where we process health or fitness information (a special category of data), we rely on your explicit consent, which you may withdraw at any time.
If you are located in Canada, we may process your information with your express or implied consent, or where permitted or required by applicable law.
4. When And With Whom Do We Share Your Personal Information?
We share information with the service providers (processors) that help us operate the Services. Each receives only the information needed to perform its function on our behalf. We do not sell your personal information for money. Our providers include:
- Hosting & infrastructure — Supabase (database, authentication, file storage, real-time features), Vercel (application hosting and performance monitoring), and Duda (our website platform and online store).
- Payments — Stripe processes payments and stores payment-card data.
- Email, SMS & communications — Resend and standard email providers send transactional emails; GoHighLevel provides customer-relationship management and sends email and SMS; Google (Gmail) is used by our staff to send and receive email with you.
- Mobile app delivery & push notifications — Expo (Expo Application Services) handles app delivery and over-the-air updates; push notifications are delivered through Apple Push Notification service (iOS) and Google Firebase Cloud Messaging (Android).
- Performance testing & results — VALD (force-plate testing) creates athlete testing profiles using athlete name, date of birth, and email; SwimCloud is used to retrieve publicly available swim race times using athlete identifiers.
- Error monitoring — Sentry receives error and crash reports. Our mobile app is configured to exclude email addresses and IP addresses from these reports.
- Accounting — QuickBooks Online receives transaction and payment records for bookkeeping and accounting.
- AI tools — OpenAI provides AI-assisted tools used by our staff to help draft communications and summarize information; we instruct staff not to enter unnecessary sensitive athlete data into these tools.
- Website analytics & advertising — Google Analytics and Meta (Facebook) measure website usage and advertising performance; maps may be displayed using Mapbox or Google Maps. See the cookies section below.
We may also share or disclose your information:
- With a parent or guardian who manages a minor athlete's account, and with the coaches assigned to an athlete.
- In connection with a business transfer, such as a merger, sale, or acquisition.
- To comply with applicable law, legal process, or enforceable governmental request, and to protect our rights, safety, and the safety of others.
5. Do We Use Cookies And Other Tracking Technologies?
On our website we use cookies and similar tracking technologies, including Google Analytics and Vercel analytics for usage and performance insights, and Meta (Facebook) tools to measure the effectiveness of our advertising. Meta tools include a browser-based pixel and a server-side Conversions API, which may receive contact details (such as email, phone, and name) and your IP address on our public booking pages for conversion measurement; contact details are cryptographically hashed before they are used for matching. Depending on your state of residence, the use of these advertising and analytics tools may be considered "sharing" for targeted advertising. You can control or disable these cookies through your browser settings, opt out using the tools offered by these providers (for example, Google's Analytics opt-out browser add-on and Meta's ad-preference settings), or ask us to stop by contacting us as described in the United States privacy-rights section below. The ASP Nexus mobile app does not use advertising trackers.
6. Is Your Information Transferred Internationally?
Our servers and service providers are located primarily in the United States. If you access the Services from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States. Where required, we take steps to ensure your information receives an adequate level of protection, including through appropriate safeguards such as standard contractual clauses.
7. How Long Do We Keep Your Information?
We keep your personal information only for as long as necessary for the purposes set out in this notice, unless a longer retention period is required or permitted by law. As general guidance:
- Account, profile, training, and health/fitness data: for as long as your account is active and for a reasonable period afterward.
- Payment and tax records: typically up to seven years, to meet legal, tax, and accounting obligations.
- Signed waivers and consent records: retained while needed for safety and legal reasons; for minors, generally until the athlete reaches the age of majority plus a reasonable period.
- Diagnostic and log data: a short period, typically up to about 90 days.
- On-device app cache: cleared automatically over time or when you log out.
When we no longer have a legitimate need to process your information, we will delete or anonymize it.
8. How Do We Keep Your Information Safe?
We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process, including encryption in transit, access controls, and secure storage of authentication credentials on your device. However, no electronic transmission over the internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security. If a data breach affects your personal information, we will notify you and the appropriate authorities as required by applicable law.
9. Children's Privacy
Our Services are intended to be used by athletes of many ages, including children and teenagers, under the supervision of a parent or guardian. We knowingly collect personal information about minors in order to provide our coaching and training Services, and we do so on the following basis:
- A parent or guardian creates or authorizes the athlete's account and provides or confirms the information we collect about the minor, including the minor's date of birth. For children under 13, we obtain consent from a parent or guardian, who creates and authenticates the account and signs the required waivers, before we collect the child's information.
- We collect from children only the information reasonably necessary to coach them, such as name, date of birth, emergency contact, and the training and health/fitness data described in this notice.
- A parent or guardian can review the personal information we have collected about their child, refuse to permit further collection or use, and request correction or deletion, at any time, including by deleting the account in the app or contacting us.
- We do not use children's information for targeted or behavioral advertising, and we do not disclose it to third parties except the service providers listed in Section 4 who help us operate the Services.
- Waivers and terms for athletes under 18 are signed by a parent or guardian, and certain social and community features are not available to athletes under 13, whose names and photos are not displayed in community feeds.
- We retain children's information only as long as needed to provide the Services and delete it when it is no longer needed.
We do not knowingly collect personal information from a child without the involvement of a parent or guardian. If you believe we have collected information from a child without appropriate consent, please contact us at team@aquaticsportsperformance.com and we will take steps to delete that information.
10. What Are Your Privacy Rights?
Depending on where you live, you may have the right to request access to the personal information we hold about you, to correct or delete it, to restrict or object to its processing, to data portability, and to withdraw consent at any time (including consent to process health and fitness information). To exercise these rights, contact us at team@aquaticsportsperformance.com. We may need to verify your identity before acting on a request, usually by confirming details associated with your account; an authorized agent acting on your behalf must provide proof of authorization, and a parent or guardian may exercise these rights for a minor's account. We will respond in accordance with applicable data protection laws. You also have the right to complain to your local data protection authority. You can update most of your information at any time within your account or the ASP Nexus app.
11. Controls For Do-Not-Track And Opt-Out Preference Signals
Most web browsers and some mobile operating systems include a Do-Not-Track ("DNT") feature, and some browsers can send an opt-out preference signal such as Global Privacy Control ("GPC"). No uniform technology standard for recognizing these signals has been finalized, and our website does not currently detect or respond to DNT or GPC signals automatically. If you would like to opt out of any sharing of your personal information for targeted advertising, you can do so by adjusting your browser cookie settings, by using the opt-out tools offered by our analytics and advertising providers, or by contacting us at team@aquaticsportsperformance.com, and we will honor your request.
12. Do United States Residents Have Specific Privacy Rights?
Depending on your state of residence (such as California, Colorado, Connecticut, Virginia, and others), you may have the right to request access to, correction of, or deletion of your personal information; to obtain a copy of it; to opt out of the sale or sharing of personal information and of targeted advertising; and to limit the use of sensitive personal information.
Categories of personal information we collect. The table below describes the categories of personal information we have collected in the past 12 months, why we collect them, whether they may be "shared" for targeted advertising, and how long we keep them. The sources of this information are you, your parent or guardian, and your coaches; the categories of recipients are the service providers listed in Section 4. We do not sell any category of personal information for money.

To exercise any of these rights, contact us at team@aquaticsportsperformance.com. You may use an authorized agent to submit a request, and we will not discriminate against you for exercising your rights. Right to appeal. If we decline to take action on your request, you may appeal by replying to our decision or emailing us with the subject line "Privacy Appeal." If your appeal is denied, you may contact your state Attorney General.
13. Do Other Regions Have Specific Privacy Rights?
If you are located in the European Economic Area, the United Kingdom, Switzerland, or Canada, you have the rights described in the privacy-rights section above, including the right to access, correct, delete, restrict, and port your personal information, to object to processing, to withdraw consent, and to lodge a complaint with your local supervisory authority. Aquatic Sports Performance LLC is the data controller of your personal information. We have not appointed a Data Protection Officer or an EU/UK Article 27 representative, as we do not target our Services to individuals in these regions; if this changes, we will update this notice.
14. Do We Make Updates To This Notice?
We may update this Privacy Notice from time to time, and we review it at least once every 12 months. The updated version will be indicated by an updated "Last updated" date and will be effective as soon as it is accessible. If we make material changes, we may notify you by prominently posting a notice or by directly sending you a notification.

16. How Can You Review, Update, Or Delete The Data We Collect From You?
You can review and update most of your personal information directly within the ASP Nexus app or your online account. You can also permanently delete your account in the ASP Nexus app under Profile → Delete Account. When you delete your account, we anonymize your personal details (such as name, email, phone number, and photo); some records — such as training history, chat history, and signed documents — may be retained in anonymized or de-identified form for safety, legal, and accounting reasons, or where retention is required by law.
For parent-managed minor accounts, the parent or guardian can delete the minor's account through the same path. You may also request to review, update, or delete your personal information — including a minor's information — by contacting us at team@aquaticsportsperformance.com. Depending on the laws of your country or state, you may also have the right to request a copy of the information we hold and details about how we have processed it, and to withdraw your consent.
